In the application of the recent amendment of the Pension Mimte to this case, there appears to be a possible ambiguity in the phrase (pensionable service', A

retiring officer, who has served in another Colony, is

entitled to receive 'a pension representing the difference

between the pension or pensions earned by that officer in respect of service......................... under which other British Colony

and a pension calculated as if his pensionable sarwing had been only in Caylon'. If the words "pensionable service" are to be interpreted as meaning 'service in a pensionable office' then my service in a pensionable office

in the Bahamas would be included. If on the other hand they were to be interpreted as meaning 'servios in respect of

which pension is actually payable to him', then service in

such a pensionable office would not be included, unless it

had been of a duration of at least ten years.

The former interpretation appears to be more

in accordance with the spirit of the amendment of the Pen-

sion Mirate, which is that for the purpose of the calculat- ion of pension, an officer's service should be deemed to be

continuous. There is no unfairness to this Colony in such

an interpretation as the Colony is sufficiently protected

by the #250/- limit. In my own case, even if I had secured

a pension from the Bahamas Government, it would have been

a very inconsiderable one - amounting only to £6, 138, 4d. for each your's service. At the very least I ought not to

be in a worse position than if this sum were actually payable by the Bahamas Government.

I would therefore submit to Your Excellency

that it wuld be reasonable and just gither that

(a) the words 'pensionable service' should be authofit-

stively interpreted as meaning 'service in pansionable

offices*, or that, in the alternative,

(b) the words 'service in pensionable offices' should

be substituted for 'pansionable service'.
